Personal Data Protection
According to Article 12 and following of Regulation (EU) 2016/679 (GDPR)

The controller of personal data provided for the purpose of fulfilling the terms of the contract is the seller.

PURPOSE OF PROCESSING, SCOPE OF PERSONAL DATA, AND LEGAL BASIS FOR PROCESSING
The buyer acknowledges that for the purposes of concluding the purchase contract, its subsequent fulfillment (order processing, ensuring goods dispatch and delivery), and the potential resolution of rights related to defective performance (complaints), the controller will process and store personal data in accordance with Regulation (EU) 2016/679 (GDPR) as follows: name, surname, delivery address, billing address, order notes, payment information, email, phone number, and purchase records.

The legal basis for processing personal data is in accordance with Article 6(1)(b) GDPR, which concerns the performance of a contract to which the buyer is a party.

CATEGORIES OF RECIPIENTS OF PERSONAL DATA
The controller is committed to not providing personal data to any other entities other than the following processors:

  • Contracted carriers selected by the buyer in the order form for the purpose of delivering the goods. The data shared will include: name, surname, delivery address, order notes, email, and phone number. Our partners include: Zásilkovna, Olicon, GLS, and Shopify Inc.
  • For more targeted advertising and promotion, we process data regarding website visits and viewed products using cookies. Based on this, we can better target ads to make them more relevant or adjust website content to include products you have shown interest in. Processing is only possible with your consent to the use of cookies. You grant consent by using our website, and this is indicated in the top bar of our site. This consent is entirely voluntary, and you may withdraw it at any time. To do this, disable cookie storage for the website tenpocit.cz in your browser settings or switch your browser to incognito mode and delete any stored cookies. Data obtained through cookies is not shared with any processors, and no identification data is shared with any processor. STORAGE PERIOD
Personal data will be stored by the controller for as long as necessary to fulfill the contract (order processing, dispatch, and delivery) and further during the statutory warranty period (24 months from the receipt of the goods) or the contractual warranty period provided.

The buyer acknowledges that, according to § 31 of the Accounting Act (No. 593/1991 Coll.), the controller is obligated to store accounting documents and records (invoices) for a period of 5 years from the end of the accounting period to which they relate (meaning, if you purchase goods during 2018, the invoice must be kept until the end of 2023). The controller is also required by § 47 of the Tax Administration Act (No. 337/1992 Coll.) to store invoices for 3 years from the end of the tax period in which the tax obligation related to the invoice arose (meaning, if you purchase goods in 2018, the invoice must be stored for tax purposes until the end of 2021). The invoice contains the following personal data: name, surname, email address, billing address, order number, and purchased product records.

The buyer further acknowledges that, according to § 35 of the VAT Act (No. 235/2004 Coll.), the controller is required to store tax documents for 10 years from the end of the tax period in which the transaction was completed (meaning, if you purchase goods in 2018, the invoice must be kept until the end of 2028). The tax document contains the following personal data: name, surname, email address, billing address, order number, and purchased product records.

Other personal data that requires your consent and is not subject to a legal retention obligation will be stored for 5 years unless consent is withdrawn earlier.

BUYER'S RIGHTS IN RELATION TO PERSONAL DATA
The buyer further acknowledges that according to Articles 15 to 21 of the GDPR, they have the right to:

  • Access personal data, which consists of the right to obtain confirmation from the controller whether personal data concerning them is being processed or not, and if so, they have the right to access these personal data and the information defined in Article 15 of the GDPR.
  • Correct inaccurate personal data concerning them and, considering the purposes of processing, the buyer has the right to complete incomplete personal data by providing an additional statement according to Article 16 of the GDPR.
  • Erasure ("right to be forgotten"), which means that the controller must erase personal data without undue delay once it is no longer needed for the purposes of fulfilling the contract, unless there is another legal reason for further processing.
  • Restriction of processing in the cases defined in Article 18 of the GDPR.
  • Data portability according to the conditions in Article 20 of the GDPR.
  • Object to the processing of personal data under Article 21 of the GDPR.

The controller will provide the buyer with information on the actions taken in response to any request no later than 15 days from receiving the request.

The controller is committed to providing the buyer with a second copy of processed personal data, free of charge, if requested, except for the first copy.

In case of doubts about the processing of personal data, the buyer has the right to contact the Office for Personal Data Protection, which is the supervisory authority in this area, and file a complaint with them.

The seller will allow purchases without registration, and the data of non-registered buyers will be used exclusively for the purpose of fulfilling the contract, not for marketing or commercial purposes.
